Terms of Use

1. Purpose
These Terms of Use (“ToU”) govern access to and use of the Plat du Jour service, an online platform enabling restaurateurs to publish their daily specials, manage their online reputation, and distribute their menu via instant messaging (WhatsApp, Telegram, etc.) and social networks, as well as enabling consumers to discover nearby restaurants and daily specials.
Use of the service implies full and complete acceptance of these ToU. If you do not accept these conditions, you must not use the service.
2. Service publisher
The Plat du Jour service is published by Plat du Jour, reachable at contact@platdujour.app. For more information, see the legal notices.
3. Access to the service
The service is accessible 24/7, subject to possible interruptions for maintenance or in case of force majeure. The publisher shall not be held liable for malfunctions related to the Internet network or third-party infrastructure (messaging, social networks, APIs).
Access to professional features (“Restaurant Dashboard”) requires account creation and subscription to a paid plan (see Terms of Sale). Browsing restaurants and daily specials by consumers is free of charge.
4. Account creation
To create a restaurant account, the User must be of legal age, have the legal capacity to contract, and act on behalf of a real establishment. They agree to provide accurate, complete, and up-to-date information (establishment name, address, phone number, email, etc.).
The User is responsible for the confidentiality of their credentials and all actions performed from their account. Any fraudulent use must be reported without delay to contact@platdujour.app.
5. User-published content
The User remains the sole owner of content published on the platform (photos, menus, descriptions, prices, etc.). By publishing content, they grant Plat du Jour a non-exclusive, worldwide, free license to display, reproduce, adapt, and distribute said content on the platform and on distribution channels authorized by the User (social networks, public pages, search engines, AI assistants).
The User agrees to publish only:
- accurate, up-to-date information compliant with applicable regulations (price display, allergens, meat origin, etc.);
- content for which they hold the rights or have the necessary authorizations;
- content that does not infringe on third-party rights or public order.
Strictly prohibited: illegal, defamatory, racist, hateful, pornographic, misleading, or deceptive content, as well as any form of spam or unauthorized advertising.
6. Artificial intelligence features
The service offers AI-based features (dish photo generation and editing, handwritten menu OCR, automatic review responses, translations, sentiment analysis). The User acknowledges that:
- AI-generated results may contain approximations or errors;
- it is their responsibility to validate all content before publication;
- Plat du Jour shall not be held liable for consequences of publishing AI-generated content without review.
7. Messaging and social media connections
The User may connect their messaging accounts (WhatsApp Business, Telegram, Messenger, Instagram) and social pages (Facebook, Instagram, TikTok, Google Business, LinkedIn) to automatically publish their daily specials and manage reviews. These connections are subject to each third-party platform's own terms, which the User agrees to comply with. Plat du Jour shall not be held liable for the suspension or banning of a third-party account.
8. Service intellectual property
The 'Plat du Jour' brand, logo, visual identity, texts, source code, databases, and platform architecture are the exclusive property of the publisher and are protected by intellectual property law. Any unauthorized reproduction or exploitation is strictly prohibited.
9. Personal data
Plat du Jour collects and processes personal data in compliance with the General Data Protection Regulation (GDPR). The User has the right to access, rectify, erase, port, and object to their data, which they may exercise at any time by writing to contact@platdujour.app.
10. Limitation of liability
Plat du Jour strives to provide a quality service but does not guarantee the complete absence of errors, interruptions, or bugs. The publisher shall not be held liable for indirect damages (loss of revenue, data loss, reputational harm) resulting from the use or inability to use the service.
Plat du Jour's liability, if engaged, shall be strictly limited to the amount actually paid by the User during the twelve (12) months preceding the triggering event.
11. Suspension and termination
In case of breach of these ToU, Plat du Jour reserves the right to suspend or terminate access to the service, without notice or compensation, particularly in case of publication of illegal content, identity theft, or attempt to circumvent the service.
12. Modification of ToU
Plat du Jour reserves the right to modify these ToU at any time. Users will be notified of changes by email or notification in their account. Continued use of the service constitutes acceptance of the new conditions.
13. Applicable law and jurisdiction
These ToU are governed by French law. In case of dispute, and after attempt at amicable resolution, exclusive jurisdiction is attributed to the competent French courts.
